’10 -10-12 weeks leave and …’, why did the Supreme Court say this to the judges of Jharkhand High Court?

The Supreme Court, in a peculiar development, on Friday (August 8, 2025), suggested taking leaves to the Jharkhand High Court judges to write pending decisions, as the court found that there are dozens of cases in which the verdict has not been pronounced. A bench of Justice Suryakant and Justice Joymalya Bagchi asked the High Court judges to take their sanctioned holidays and complete the pending work.

Supreme Court bench gave instructions to Jharkhand High Court judges

The bench told senior advocate Ajit Sinha, appearing for the Jharkhand High Court, “61 cases are pending. Ask the judges of the Jharkhand High Court to write decisions with their approved holidays of 10-12 weeks. Nowadays judges have a lot of holidays left. Just get rid of these matters. People need decisions, they do not worry about jurisdiction or anything else. Regarding whether to give relief or not, give logical orders on it. ”

6 cases are pending in Jharkhand High Court

Sinha was citing data up till January 31, 2025 and he said that since then orders have been passed in many cases. On this, Justice Suryakant said that 61 cases are a large number of cases and they asked them to convey the suggestion of the court to the Chief Justice of the High Court.

Justice Suryakant said, “This is our request. Just do it. Remove our suggestion to the Chief Justice of the High Court. “The bench said in the order,” The High Court judges will take immediate steps. The case will be kept for further consideration after three months. The necessary work should be completed by that time.

Decision not pronounced in Jharkhand High Court in many cases since 2023

The apex court gave this order on the petitions in which students from remote tribal areas of Jharkhand had complained about not pronounced 2023 in cases of home guards. However, Sinha said that the High Court has pronounced the order in the case of students. The Jharkhand High Court has come under the investigation of the Supreme Court due to not pronounced decisions for years, especially in criminal cases including death penalty and life imprisonment.

SC Status reports for pending cases from Jharkhand High Court on 16 May

On May 16, 2025, the Supreme Court had asked the High Court to file a status report on the pending cases in which the verdict was reserved on or before 31 January 2025 in both criminal and civil cases. The students had complained that the final hearing of their case was held on April 6, 2023, but no decision was pronounced. According to the petitions filed through advocate Vanya Gupta, the candidates of Home Guard posts have requested the High Court to direct the verdict in their matters.

Recruitment was canceled after name in the list, then the candidates filed a petition

The petitioners moved the High Court when the Jharkhand government canceled the recruitment for more than 1,000 posts of home guards advertised in 2017, while their names were in the list. After hearing the case from 2021, the High Court reserved the petitions filed by more than 70 candidates for the order on April 6, 2023.
