Challenging the online gaming act, the High Court asked the Center- how will the law be done without rules?
The Delhi High Court directed the Central Government to set up the authority soon to implement the promotion of online gaming and the Regulation Act recently passed and notify the rules. The bench of Delhi High Court Chief Justice Devendra Kumar Upadhyay and Justice Tushar Rao Gedela gave this order while hearing the petition in which the new online gaming law has been challenged.
During the hearing, the Delhi High Court told the Central Government that till you will not form the authority and notify the rules, you will not be able to work effectively on this law.
Important arguments of central government in court
In the High Court, Solicitor General Tushar Mehta, on behalf of the Central Government, told the court that the government is in the process of forming authority under this law and setting up rules. In the Delhi High Court, Tushar Mehta argued that the government is promoting e-sports and safe educational and social games, but online money game is causing bad habit, mental stress and even suicide in children. Therefore, it is very important to stop it.
Provision of law
The Act which was passed by Parliament on August 21, stops all types of online money games. It also encourages e-sport and safe online social and educational games.
Objection of petitioner
This petition has been filed in Delhi High Court by Bagheera Carrom Private Limited by an online carrom gaming platform. In the application filed in the Delhi High Court, the petitioner alleges that this law was in a hurry without consultation with the stake holder. Due to this, the fundamental rights of companies and players have been violated.
The petition states that the new law stops all types of online real money games without discrimination, whether it is based on skills or luck. The Delhi High Court has listed the next hearing of the case for 8 weeks later.
