‘If you are a woman then you can give bail’, what did the woman accused of BMW accident do this from the court?

Last week, a senior Finance Ministry officer died in a BMW and two -wheeler collision in Delhi, on which a woman was arrested on Monday (September 15, 2025). The arrested accused woman Gaganpreet made a big statement during a hearing in a Delhi court on Wednesday (September 17, 2025).

Despite the postponement of the hearing on behalf of Patiala House Court for Saturday, accused woman Gaganpreet’s lawyer and senior advocate Ramesh Gupta demanded bail in the case, saying that DTC bus colliding with a two -wheeler and allegedly an ambulance passed from there should also be made accused in this case, this case is very much discussed and angry in the whole country.

BMW car collides with Navjot Singh’s bike

In fact, the entire incident took place on Sunday (September 14, 2025) near Dhaula Kuan in Delhi, where a BMW car hit the bike of Deputy Secretary Navjot Singh in the Department of Economic Affairs, in which he died. Navjot’s wife, who was sitting behind the bike, has also suffered injuries.

Advocate Ramesh Gupta, who is advocating on behalf of the accused woman in the court, said, ‘This incident is unfortunate and more than 5000 such incidents happen every year. At the same time, the lawyer raised the question and said why no action was taken against the DTC bus.

Police registered a case after 10 hours

The lawyer alleged that the police claim that after hitting the BMW, the bike was hit by the DTC bus. The lawyer also alleged that where the incident happened, the police said that after the accident, the bike collided with the DTC bus, why did the police not seize the bus? An ambulance was passing from there, but he refused to help the victims.

The lawyer said why the police registered a case after 10 hours? There is a lot of pressure on the police, so she can do anything. Gupta also questioned the police’s decision to impose Section 105 of the Indian Justice Code (BNS) against his client in the court. According to this section, whoever does non -destiny killing can be imprisoned for life or imprisonment of at least 5 years or up to 10 years.

Case registered against accused under these sections

Advocate Gupta said in the court, ‘The police imposed section 304 (which is equal to Section 105 of BNS) against my client? Investigating officers are well aware that there is a need to include sub -section A or B. My experience is from 304 (2), which gives the court the right to grant me bail.

The lawyer of the accused said, “If that woman is an accused, then you can also give bail in cases of death sentence and life imprisonment.” Apart from Section 105, the accused has also been accused under Section 281 of BNS (driving at a high speed) and section 125B (to endanger the life or personal security of others).

Government lawyer raised questions on the accused

However, the prosecution (government lawyer) raised the question as to why the accused informed the police only 5 hours after the accident. He said, ‘If the accused knew that the victim had serious injuries, then why did she not immediately take her to a nearby hospital?’ Delhi Police also claimed that the accused woman was not injured in the incident.
