Question on central government’s policy, Delhi High Court said- ‘Appoint qualified women in Air Force’
The Delhi High Court has reprimanded the Central Government and said that when eligible women candidates are present, it is unfair and discriminatory to leave the post of Air Force vacant. During the hearing of the case, the Delhi High Court said that Archana, the successful female candidate in the NDA 2023 examination, should be appointed to an vacant post immediately.
In May 2023, the Union Public Service Commission issued an advertisement for 92 posts in Air Force Flying Branch through NDA exam. Two of these posts were especially reserved for women and at the remaining 90, all qualified candidates were open to both male and female. A total of 70 men and two women were selected after the selection process, but 20 posts remained vacant due to lack of sufficient number of qualified male candidates.
Women candidate filed for admission in Delhi High Court
Women candidate Archana, who was in seventh place in the female merid list, knocked on the door of Delhi High Court. In the application filed in the Delhi High Court, he argued that when the male candidates were not found to be qualified and 20 posts were left vacant, then qualified women candidates should be appointed to those posts.
Delhi High Court comments
He said that there is no justification for appointing only 2 women and ignoring the remaining women candidates. In the Delhi High Court, a bench of Justice C. Hari Shankar and Justice Om Prakash Shukla while hearing the petition said that 90 posts were not reserved only for men.
The court said that these posts were open to all candidates. In today’s time, discrimination between men and women is not only inappropriate, but also against the law. It is no longer relevant to deprive someone on the basis of gender. Now that round is over when women were kept behind in the army.
Delhi High Court order
The court even said that the difference between a man and a woman is only biological, it should not have any importance in the job and opportunity. The Delhi High Court ordered the Central Government that the petitioner Archana should be immediately appointed to an vacant post in the Air Force Flying Branch. They should be given all service, profit, salary and seniority equal to 70 male and 2 female candidates already selected.
