The Supreme Court has imposed a case with strict orders against the High Court Judge for a re -hearing. The case was settled by the Supreme Court on Tuesday (August 5, 2025). But on the Supreme Court website, it has been informed about its hearing again on Friday (August 8, 2025).

Supreme Court Justice J. B. Pardiwala and R.K. Mahadevan’s bench gave strict orders about Justice Prashant Kumar of Allahabad High Court. The judges had asked the Chief Justice of the Allahabad High Court to sit Justice Prashant Kumar in the division bench with a senior judge. Even if it is necessary to sit in a single bench, do not let any criminal case listen.

What Supreme Court said on the decision of Allahabad High Court judge,

The judges, angry with the decision of Justice Prashant Kumar, who justified the registration of the criminal case in the civil dispute, said, “We have not yet seen a bad order from it. The judge who has ordered the judge has made fun of justice. Sometimes it seems to think whether such orders are given in the absence of information of the law or due to any external reason.”

In which case the High Court judge had given the decision

The case that the Supreme Court had expressed displeasure was a business dispute between two companies. One party had registered a criminal case in Kanpur after not getting payment from the other party. The second company challenged the registered criminal case in the High Court. But Justice Prashant Kumar dismissed his petition. In an order given on May 5, 2025, he said that the complainant is a small company. The civil lawsuit lasts for a long time. It will take a long time to get him money in this way.

Supreme Court gave instructions to Chief Justice of Allahabad High Court

Angered by the High Court judge’s decision, the Supreme Court canceled it without issuing notice. The judges sent the matter back to the High Court and the Chief Justice of the High Court has been asked to put it to another judge for hearing. Also, Justice Prashant Kumar said that as long as he is in office, he should never be allowed to hear any criminal case.

It is being told that many judges of the Supreme Court had expressed concern over this strict decision. He believed that it is not appropriate to give such a judicial order about a high court judge. The Chief Justice in the High Court has the Master of Roster. What kind of case a judge will listen to, he will sit in a single bench or with another judge, it is the privilege of the High Court Chief Justice to decide all this. In such a situation, it is not right to issue instructions to them. Perhaps this is the reason that the Supreme Court has once again put the case for consideration.
