The case of catching stray dogs in Delhi-NCR arose before the Chief Justice, the petitioner called it contrary to the old orders
The issue of the Supreme Court order related to catching stray dogs in Delhi-NCR was put in front of Chief Justice Bhushan Ramakrishna Gawai on Wednesday (August 13, 2025). The lawyer said that earlier another bench of the Supreme Court had ordered the dogs to stay in their place. In Delhi, the case of deficiencies in following the Animal Birth Control Rules is pending in front of the bench headed by the Chief Justice itself. The order came on Monday is contrary to both.
After listening to advocate Nanita Sharma, the Chief Justice said that he will consider this subject. Keep in mind that on Monday, a bench headed by Justice JB Pardwala ordered all stray dogs to be caught in Dog Shelter Home in Delhi-NCR. Animal Rights Organizations are calling it against the old orders of the law and the Supreme Court itself.
Animal Birth Control Rules, 2023, provides for stray dogs to control the population of stray dogs and to protect them from rabies infection. According to the rules, there is a provision to leave dogs back to their area after sterilization and vaccination. In the order given on Monday, the court asked the dogs not to leave it back under any circumstances.
On 8 July 2024, a bench of Justice BR Gavai and Justice K V Vishwanathan issued a notice to the Delhi Government, MCD and Animal Welfare Board on the plea of NGO named Conference for Human Rights. It was said in the petition that the sterilization and vaccination of dogs in Delhi are being taken care of. The court should ensure compliance with Animal Birth Control Rules, 2023.
