While giving reservation, demand for a policy of priority to the poor, Supreme Court sought answers from the central government

The Supreme Court has issued a notice on the demand for priority on the basis of economic status in reservation. It has been said in the petition that the benefits of reservation in Scheduled Castes, Scheduled Tribes and OBC category are getting more benefits to those who are financially prosperous. This is not according to the basic objective of reservation to bring equality in society.

Petitioners Ramashankar Prajapati and Yamuna Prasad have demanded that the Supreme Court ask the government to change the reservation policy. While giving reservation in government jobs and higher education, financially weaker people should get priority. They should be seen as a separate subclass of reserved class. The petitioners have cited the decision of the Supreme Court in the Devinder Singh vs Punjab case in which the subjugation of reservation was justified.

On Monday (August 11, 2025), the petition started for hearing in the bench of Justice Surya Kant and Justice Joymalya Bagchi. Advocate Reena N Singh, presented for the petitioners, said that justice is not justice to make laws. Justice is when the benefits of the law reach the needy. Reservation also requires following this principle.

After a short debate, the Supreme Court issued a notice to the Central Government, considering the consideration of the petition as necessary. Pointing to the impact of the demand kept in the petition, Justice Surya Kant, president of the bench, told the petitioner’s lawyer, ‘You should be ready. You will have to face a lot of opposition.
