‘I am probably of old thoughts but the wife cannot say that …’, Supreme Court judge Justice Nagratna said to the couple living separately
The Supreme Court on Thursday (August 21, 2025) made an important comment about the marriage and said that after marriage, none of the husband or wife can say that they want to be independent of their spouse. The court said this while hearing the case of a couple living separately. Both have two children, husband lives in Singapore and wife in India. The wife says that she does not want to depend on her husband, on this, Justice B. V. Nagratna said that she is probably of old thoughts, but no wife can say that I do not want to depend on my husband.
According to PTI report, Justice B. The bench of V. Nagaratna and Justice R. Mahadevan warned that if someone wants to be independent, he should not marry. The Supreme Court said, ‘We are absolutely clear. No husband or wife can say that as long as we have a matrimonial relationship, I want to be independent of another spouse. This is impossible. What is the meaning of marriage, two hearts, individuals come together. How can you be independent? ‘
The court told the couple that if both of them stay together then we will be happy because the children are very young. They should not see the house broken. What is their fault in this? The court asked the husband and wife to resolve whatever differences between them. The court said that there is some dispute between every husband and wife. On this, the wife said that the clap does not ring with one hand, then the court said that they have given this instruction to both, not to any one.
The wife says that her husband, who was living in Singapore and is now in India, is not ready to resolve the matter. He only wants the right to meet and children’s protection. The woman lives in Hyderabad. The court asked the woman why she was not returning to her husband to Singapore. What is it difficult to return to Singapore with children.
The woman, citing some difficulties, said that due to her husband’s antics in Singapore, it has become very difficult for her to return. As a single mother, the woman, while emphasizing the need for a job for livelihood, claimed that she had not received any alimony from her husband living separately.
The husband’s lawyer said that both have a very good job in Singapore, but the wife has refused to return to Singapore with the children. The bench said, ‘You (wife) can get a job, may not get it, but the husband will have to take care of you and the children.’ At the same time, the court suggested the husband to deposit some amount for wife and children. However, the wife told the court that she does not want to depend on anyone. Justice Nagratna said, ‘You cannot say that. After getting married, you become emotionally dependent on your husband. May not be financially.
He said, ‘You cannot say that I do not want to depend on anyone. Then why did you marry? I do not know, I am probably old thoughts, but no wife can say that I do not want to depend on my husband. The woman has sought some time to consider this issue.
The bench told the parties, ‘You are all educated. You have to resolve these issues. The petitioner’s counsel said that the petitioner (husband) is currently in India and will return to Singapore on September 1. The Supreme Court directed the petitioner to deposit five lakh rupees for the maintenance of wife and children without adversely affecting other orders issued against them and adjourned the next hearing of the case for 16 September.
