‘Release today?’, Supreme Court spoke to separatist leader Shabbir Ahmed Shah with interim bail application

In the case of Terror Funding, the Supreme Court has rejected the interim bail application of Kashmiri separatist leader Shabbir Ahmed Shah. On Thursday (September 4, 2025), Shabbir Ahmed Shah requested the interim bail citing serious illness.

According to PTI report, the bench of Justice Vikram Nath and Justice Sandeep Mehta was hearing the case. The bench refused to grant bail to Shabbir Ahmed Shah, but has sought a reply from the Central Investigation Agency (NIA) on its petition challenging the June 12 High Court order. He filed this petition against the High Court’s order of June 12 to refuse to grant bail. The court has asked the NIA to reply in two weeks.

On behalf of Shabbir Ahmed Shah, Senior Advocate Colin Gonzalvis requested interim bail, saying that the petitioner is extremely ill. On this, Justice Vikram Nath said that no interim bail will be received. Demanding interim bail, Shabbir Ahmed Shah’s lawyer Gonzalvis said, “I (Shah) needs interim bail.” On this, Justice Vikram Nath said, ‘Release you today?’ After this, Gonzalvis requested a early hearing on the petition of Shabbir Ahmed Shah and the bench fixed the date of hearing two weeks later.

The High Court refused to grant bail to Shabbir, saying that it is likely that he may be involved in illegal activities and can also try to influence witnesses when he goes out of jail. Shabbir Ahmed Shah was arrested by NIA on June 4, 2019.

In 2017, the NIA filed a case against 12 people for raising and collecting money to create a disruption by plotting stone pelting, damaging public property and causing a conspiracy to wage war against the Government of India.

Shabbir Ahmed Shah is accused that he played an important role in encouraging separatist or climbing movements in Jammu and Kashmir by inciting the common people to raise slogans in support of the separation of Jammu and Kashmir, by paying tribute to the families of the slain terrorists or extremists, by paying tribute to the martyr, by receiving money through Hawala transactions and raising money through the Line of Control Business through Hawala transactions, and by collecting money through the Line of Control Business. Used to promote destructive and extremist activities in.

The High Court had said that the Constitution gives the right to freedom of expression, but it also imposes proper restrictions on steps such as public system, decency, morality, or abetment for any crime. The High Court had said, “This right cannot be misused under the guise of organizing rallies, in which a person gives inflammatory speech or provokes the public for illegal activities that harm the interest and integrity of the country.”

The court rejected Shabbir Ahmed Shah’s appeal against the subordinate court’s order of July 7, 2023, refusing to grant him bail. The High Court had also rejected the alternative application of detention in Shabbir Ahmed Shah’s house in view of the serious nature of the allegations.

The court had said that it is the president of the illegal organization Jammu and Kashmir Democratic Freedom Party. The High Court had analyzed a table giving detailed information about the 24 cases pending against Shabbir Ahmed Shah, which included his involvement in many similar criminal cases and conspiring to conspiracy to separate Jammu and Kashmir from the Union of India.
