‘Will PM and CM run the government by staying in jail?’ Home Minister Amit Shah said while presenting the bill in Parliament

Union Home Minister Amit Shah said on Wednesday (August 20, 2025) that now the people of the country will have to decide whether it is appropriate to run a government of a minister, Chief Minister or Prime Minister by staying in jail. Three bills were introduced in the Lok Sabha on Wednesday, which was introduced in the Lok Sabha on Wednesday, to remove the Prime Minister, Chief Ministers and Ministers detained from the post, which the House decided to send to the Joint Committee of Parliament for study.

Later on his proposal, the House decided to send the three Bills to the Joint Committee of Parliament.

‘Now the people of the country will decide’

Shah said that on the one hand Prime Minister Narendra Modi has presented a constitution amendment to bring himself under the purview of law and on the other hand the entire opposition has opposed this under the leadership of Congress to stay out of the purview of law, run governments from jail and not to give up the chair.

He wrote on the social media ‘X’, ‘Now the people of the country will have to decide whether it is appropriate to run a minister, Chief Minister or Prime Minister’s government by staying in jail?’ Shah said that seeing the commitment of the Modi government against political corruption in the country and the anger of the people, he introduced the Constitutional Amendment Bill with the consent of the Lok Sabha Speaker in Parliament, so that important constitutional posts, such as Prime Minister, Chief Minister, Central and State Government Ministers, could not run the government while in jail.

Minister running government from jail without resigning: Amit Shah

He wrote, ‘The purpose of this bill is to raise the level of morality falling in public life and bring purity in politics.’ Shah said that the law that will come into existence from these three bills is that no person can arrest and rule from jail as a minister of Prime Minister, Chief Minister, Central or State Government.

He said, ‘When the Constitution was formed, our Constitution makers did not even imagine that in future such political persons would come, who will not resign on moral values before they are arrested.’ Shah said that in the last few years, such a surprising situation arose in the country that the Chief Minister or the minister continued to run the government immorally from jail without resigning.

PM or CM will have to resign on 31st day

He said that in this bill, the accused leader has also been given a provision to take bail from the court within 30 days of arrest. If they are unable to get bail in 30 days, then either the Prime Minister at the Center and the Chief Minister in the states will be removed from the posts, otherwise they themselves will be disqualified to act legally.

He said, “If such a leader gets bail after the legal process, then he can be held again in his post.” Shah said that the country also remembers the time when the then Prime Minister Indira Gandhi gave such a privilege to the Prime Minister from the Constitution Amendment No. 39 in this great house that no legal action could be taken against the Prime Minister.

Resigned before being arrested

He said, ‘On the one hand it is the work culture of the Congress and their policy that they amend the Constitution to the Prime Minister and above the law. Whereas, on the other hand, the policy of the Bharatiya Janata Party is that we are bringing the Prime Minister, Minister, Chief Ministers of our government under the purview of the law.

The Home Minister said, ‘Today, a Congress leader in the House has also made personal remarks about me that when the Congress implicated me in a completely fake case and arrested, I did not resign. I want to remind the Congress that I had resigned before I was arrested and even after coming out on bail, I did not take any constitutional post until I was completely innocent from the court.

Opposition’s double character

He said, “The court dismissed fake allegations against me, saying that the matter is inspired by the spirit of political revenge.” Shah said that BJP and NDA have always been in favor of moral values and Lal Krishna Advani also resigned from his post only if he was alleged. He said that on the other hand, the Congress party is still carrying forward the ‘unethical tradition’ launched by Indira Gandhi.

Shah said, ‘Lalu Prasad Yadav who had brought the Congress party ordinance to save, which Rahul Gandhi opposed, today the same Rahul Gandhi is embracing Lalu ji at Gandhi Maidan in Patna. This double character of the opposition has understood the public well.

‘India’ alliance together to save corrupt people

He said that it was already clear that this bill would be placed before the Joint Parliamentary Committee of Parliament (JPC), where it would be discussed intense. Shah said, ‘Still, except all kinds of shame and haya, to save the corrupt, the entire’ Indi ‘(coalition alliance’ India ‘) under the leadership of the Congress was gathered and was opposing it in a fierce manner. Today, the opposition has been completely exposed to the public.
